Additional Terms of Service for Managed Google Domains
The following Additional Terms of Service for Managed Google Domains, together with the Google Terms of Service and the Google Privacy Policy, constitute your Domain Administrator agreement (the “Managed Google Domain Terms”). By clicking “Accept,” you acknowledge and agree to the Managed Google Domain Terms. Your continued use of the Services constitutes consent to any updates.

Definitions
- “Admin Console” means the online tool provided by Google to the Domain Administrator for use in reporting, to manage accounts on the Customer Domain, and certain other administration functions.
- “Customer Domain” means the domain used by you in connection with the Services.
- “Customer Data” means data provided, generated, transmitted, or displayed by End Users via the Services on the Customer Domain
- “Domain Administrator” means the End User designated by you to use the Admin Console for administration of the Services on the Customer Domain.
- “End User” means any individual using the Services from an account on the Customer Domain.
- “EU Data Protection Legislation” means the applicable national provisions adopted pursuant to the EU Directive 95/46/EC on the Protection of Individuals with Regard to the Processing of Personal Data and on the Free Movement of Such Data.
- “Services” means Google’s products and services as defined in the Google Terms of Service or any other applicable terms to which you agree.

Scope
The Managed Google Domain Terms apply to the use of the Services by an End User and to your use of the Admin Console. For some Services, you may be asked to read and agree to service-specific additional terms. If you agree to service-specific additional terms, those additional terms become part of your agreement with Google and may supercede conflicting provisions in these Managed Google Domain Terms. -
Admin Console
Any Domain Administrator will have access to the Admin Console. You are responsible for authorizing End Users as Domain Administrators, and ensuring that all Domain Administrator comply with the Managed Google Domain Terms. You agree that Google's responsibilities do not extend to the internal management or administration of the Services. You may have the option of continuing to use the Admin Console even if you maintain no End User seat licenses for any other Service; if you do so, these Managed Google Domain Terms will continue to govern that use. -
Acceptable Use.
Use of the Services is subject to the Acceptable Use Policy. Failure to use the Services in a manner consistent with the Acceptable Use Policy may result in suspension or termination of the offending End User account or your G Suite or other applicable Google account(s), at Google’s sole discretion. -
Restrictions on Use
Unless Google specifically agrees in writing, you will not, and will use commercially reasonable efforts to make sure a third party does not: (a) sell, resell or lease the Services to a third party or otherwise make the Services available on a paid basis to a third party; (b) attempt to reverse engineer the Services or any component; (c) attempt to create a substitute or similar service through use of, or access to, the Services; (d) use the Services for high risk activities where the use or failure of the Services could lead to death, personal injury, or environmental damage (e.g., nuclear facilities, air traffic control, life support systems); or (e) use the Services to store or transfer any Customer Data that is controlled for export under the International Traffic in Arms Regulations (“ITAR”) maintained by the Department of State. -
Compliance with Laws
Where applicable, you are solely responsible for compliance with all laws and regulations that apply to your use of the Services, such as the U.S. Family Educational Rights and Privacy Act (FERPA), Children’s Internet Protection Act (CIPA), and the Children’s Online Privacy Protection Act of 1998 (COPPA), including obtaining parental consent concerning any collection or dissemination of personal information of students or children. Other laws applicable to your use of the Services may include copyright laws or data protection laws. Unless Google agrees otherwise in an appropriate Business Associate Agreement, you may not use the Services in connection with any protected health information subject to the Health Insurance Portability and Accountability Act of 1996 and the rules and regulations thereunder (“HIPAA”). -
Privacy and Data Protection
You are responsible for protecting the privacy and data protection rights of your End Users under all applicable laws and regulations, including communicating a legally adequate privacy notice to End Users, and obtaining and maintaining any required consents from End Users to allow your and Google’s access, monitoring, use and disclosure of Customer Data in connection with the use and provisioning of the Services under these Managed Google Domain Terms. If the EU Data Protection Legislation applies to you as a controller of any personal data provided, generated, transmitted or displayed via the Services:- You will comply with your obligations as controller under the legislation;
- You instruct Google to process such personal data as described in the Privacy Policy and otherwise to fulfill its obligations under these Managed Google Domain Terms, and Google will not process such data for any other purpose without your instructions;
- Google will take appropriate technical and organizational measures to protect such personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, and Google will take appropriate steps to ensure compliance with those measures; and
- Google Inc. will remain enrolled in the U.S. Department of Commerce Safe Harbor Program or adopts an alternative solution that achieves compliance with the terms of the EU Data Protection Legislation for transfers of personal data to a third country for the duration of these Managed Google Domain Terms.

Miscellaneous
- No Technical Support Services or Service Levels. Unless Google agrees otherwise in service-specific terms, Google will not provide technical support services or commit to any service levels under these Managed Google Domain Terms.
- Interpretation of Conflicting Terms. If there is a conflict between the documents that make up the Managed Google Domain Terms, the documents will control in the following order: any service-specific terms to which you agree for a Service used in connection with the Admin Console, the Additional Terms of Service for Managed Google Domains, the Google Terms of Service, the Google Privacy Policy, and other terms located at any URL.
- Third Party Requests. You are responsible for responding to all third party requests concerning your or your End Users’ use of the Services. Google will, to the extent allowed by law and by the terms of the third party request: (a) promptly notify you of its receipt of a third party request; and (b) comply with your reasonable requests regarding its efforts to oppose a third party request
- Entire Agreement. The Managed Google Domain Terms, including all documents referenced herein and any service-specific additional terms you agree to, constitute the parties' entire agreement relating to their subject matter and supersede and terminate in their entirety any prior or contemporaneous agreements relating to that subject matter. For clarity, service-specific additional terms you agree to and the terms located at any URL referenced in the Managed Google Domain Terms are hereby incorporated by this reference.
